IDYLLICA owns all copyright, intellectual property, industrial property, “know-how,” and all other related rights concerning the content of the website www.idyllica.es and the services offered on it, as well as the necessary programs for its implementation and related information.

Reproduction, publication, and/or use of the content, total or partial, of the website www.idyllica.es without prior written consent is not permitted.

Intellectual property of software

The user must respect third-party software made available by IDYLLICA, even if it is free or publicly accessible.

IDYLLICA holds the necessary exploitation and intellectual property rights for the software.

The user does not acquire any rights or licenses over the contracted service’s software or the technical information related to service monitoring, except for the rights and licenses necessary to fulfill the contracted services and only during their duration.

For any action beyond contract compliance, the user must obtain prior written authorization from IDYLLICA. The user is prohibited from accessing, modifying, or viewing the configuration, structure, and files of IDYLLICA’s servers. The user assumes civil and criminal liability for any incidents caused by negligent or malicious actions on the servers and security systems.

Intellectual property of hosted content

The use of IDYLLICA services contrary to intellectual property laws is prohibited, particularly:

• Any use that violates Spanish laws or infringes third-party rights.
• The publication or transmission of any content deemed violent, obscene, abusive, illegal, racist, xenophobic, or defamatory by IDYLLICA.
• Cracks, program serial numbers, or any other content that violates third-party intellectual property rights.
• The collection and/or use of personal data from other users without their explicit consent or in violation of Regulation (EU) 2016/679 of the European Parliament and Council, of April 27, 2016, regarding personal data protection and free movement.
• The use of the domain’s mail server and email addresses for sending unsolicited bulk emails.

The user bears full responsibility for the content of their website, transmitted and stored information, hyperlinks, third-party claims, and legal actions regarding intellectual property, third-party rights, and the protection of minors.

The user is responsible for adhering to applicable laws, regulations, and rules related to online services, e-commerce, copyright, maintaining public order, and universal principles of Internet usage.

The user shall indemnify IDYLLICA for any expenses incurred due to IDYLLICA’s involvement in legal proceedings attributable to the user, including legal fees and defense costs, even if the legal decision is not final.

Protection of hosted information

IDYLLICA performs backups of hosted content on its servers. However, it is not responsible for the accidental loss or deletion of user data. Similarly, IDYLLICA does not guarantee the complete restoration of user-deleted data, as such data may have been deleted and/or modified during the period since the last backup.

Services offered, except for specific backup services, do not include restoring content stored in IDYLLICA backups when the loss is attributable to the user. In such cases, a fee will be determined based on the recovery’s complexity and volume, subject to user approval.

Data restoration is only included in the service price when the content loss is due to causes attributable to IDYLLICA.

Commercial communications

In compliance with the LSSI, IDYLLICA will not send advertising or promotional communications via email or other electronic means without prior explicit consent from the recipients.

For users with a prior contractual relationship, IDYLLICA is authorized to send commercial communications related to products or services similar to those initially contracted.

In any case, the user, upon verifying their identity, may request not to receive further commercial information through Customer Service channels.
